Now we dive into to the details in which we recommend splitting up the tasks in the following four stages (within each stage, we have created a checklist with the most important details which must be considered in the process of an execution and implementation).

Stage 1: Planning of the Expansion

Whether hiring process, selecting partners or location, or supply chain, we set up with each company an individual execution process to ensure that we meet all the requirements.

By start executing the expansion of your company, we will be looking at following factors:

found a company

Partners

With our network, we ensure you partners in various areas, depending on your industry and for what it will be needed. Below are some possible partnerships listed up which might be demanded.

We make sure that we will have a first licensed lawyer in Mexico (appointed to the state), respective law firm, which represent you and your company and ensure the legality of the contract they are undertaking. They will help us to setup your business in Mexico handle all the legal terms, create contracts, found the company, safety regulations, and many more things. Such a law firm can provide important guidance through, creating a corporation, advising us on Mexican labor law, Mexico’s tax laws, and all red tape that goes along with doing business in Mexico.

Based on your needs, we will select a freight partner who will support us to ship materials and equipment’s to Mexico and to export the processed materials. One criterion to find the right partner will be also getting quotations for the freight (shipping / air cargo / custom / documentation / insurance). We also must also make an analysis of where the raw materials are coming from to plan the shipments.

Besides using internet platforms like LinkedIn or Mexican recruiting websites, it often makes sense to cooperate first with a local third partner, who knows the market, law, and employment rights well.

We select with you the partner to transport your goods from or to the intermodals respectively airports. In addition, we have a large network for delivering trucks by camions to the United States.

Finding a partner who will take over questions in terms of insurance (employees, warehouse, inftrastructure, transfer of goods, etc.).

We will create standardized English and Spanish contracts which will comply with the Employment in Mexico and which is regulated by the Federal Labor Law (FLL). The FFL outlines the appropriate rights and obligations of both, employees and employers (holidays, insurances, taxes, benefits, night shifts, resignation time, probationary period, payroll, etc.).

Nowadays with digitization, there are quite many recruitment solutions possible without even having a lot of expenses. You create new job descriptions in your country and publish them on various platforms such as LinkedIn, Indeed, or other internet websites, which are quite common in Mexico.

It is crucial to set up plans how we want to start training courses for our future employees once we are ready to start with the operations. We must ensure that employees have sufficient information and knowledge to execute their tasks as well as data must be available.

One challenge when moving and setting up a business in Mexico, is adapting to the cultural differences and familiarize with the government regulations. The disparity in the ways in which the 31 states govern may also be problematic as each one is run differently. The good thing though is that foreigners can own 100% of a Mexican corporation and open their business in Mexico. It is now easier for those looking to start a business in Mexico to do so since the North American Free Trade Agreement was implemented in 1994. Mexico’s legal system and tax laws for businesses do not discriminate between foreigner business or Mexican National owned businesses. Stage 2: Execution of the Expansion

Now it counts: Finalization and mobilization of the plans! Many activities can be done in advance such as creating contracts, founding company, hiring lawyer, or planning budgets. The tasks below will be executed, when everything is already in an advanced stage.

Visit possible properties

We will start searching our possible properties through websites and network we have. Once we have found potential partners which meet our requirements from the worked-out specification sheet, we will visit them locally. The next step will be to start the negotiation process and look at the contract details.

Recruitment & Partners

We will also seek for potential partners which we have analyzed in the first stage such as HR, Attorney or Assembling. Beside that, we will start the recruitment process to find the potential candidates for the key positions with tools like LinkedIn or recruitment platforms.

In that, we must decide, who brings what knowledge from Switzerland and whether employees from Europeans can work in Mexico or vice versa and with which VISA.

Once we have gone through the selection process and found potential partners whom we want to cooperate with, we will go into the negotiations based with our specification sheets.

Transfers and install  machines and IT

Once we have founded the company legally in Mexico and understand the important legal terms, sorted out the export regulations and we have some key people hired already, we will start with the selected freight partner the transfer of the machines and raw materials.

Once the machines and raw materials have arrived, will do the installments of all those facilities and stock the materials in the (rented) property. Besides, we also have to organize the furniture (if not already available), IT facilities such as computer, laptop, printing, internet connection and many more things.

Relocation of jobs

There might be employees needed from your current company which will be working for a certain stage in Mexico, thus work permissions must be acquired by the government.
